Name Changes
North Carolina law allows a spouse, in conjunction with a divorce, to take a name other than the current spouse’s last name. A name change is requested when the complaint is filed or the answer.
In the case of changing a name outside of marital separation the following individuals may seek a change of name:
- An Adult
- An adult on behalf of a minor child
Each adult seeking a name change must submit his or her fingerprints for a state and national criminal history records check 10 days prior to filing, and most have a certified birth certificate. Once a petition for change of name is filed, the request will often be granted unless a Court finds a statutory reason not to grant the name change.
